Notice of Privacy Practices
THIS NOTICE DESCRIBES HOW MEDICAL INFORMATION ABOUT YOU MAY BE USED AND DISCLOSED AND HOW YOU CAN GET ACCESS TO THIS INFORMATION. PLEASE REVIEW IT CAREFULLY.
Effective date: October 18, 2026
1. Our Commitment to Your Privacy
At Element MD, we understand that medical information about you and your health is highly personal. We are committed to protecting your Protected Health Information (PHI). This Notice of Privacy Practices describes how we may use and disclose your PHI to carry out treatment, payment, or healthcare operations, and for other purposes that are permitted or required by law.
2. How We May Use and Disclose Your PHI
We may use or disclose your PHI for the following primary purposes:
- For Treatment: We may use and disclose your PHI to independent, US-licensed healthcare providers in our provider network, Scriptful Inc., and to our pharmacy partner, ScriptfulRX, to provide, coordinate, or manage your healthcare and related services. For example, your medical intake form will be reviewed by a provider to determine clinical appropriateness and sent to the pharmacy to dispense your prescription.
- For Payment: We may use and disclose your PHI so that the services you receive may be billed to and payment may be collected from you or a third party (such as an HSA/FSA administrator).
- For Healthcare Operations: We may use and disclose your PHI for our platform’s business operations. These uses are necessary to run Element MD and ensure that all patients receive quality care. For example, we may use your PHI to review our care processes, evaluate the performance of our clinical partners, or conduct compliance audits.
3. Other Permitted Uses and Disclosures
We may also use or share your PHI in the following specific circumstances without your direct consent:
- As Required by Law: We will disclose PHI when required to do so by federal, state, or local law.
- Public Health Risks & Adverse Events: We may disclose your PHI to public health authorities to prevent or control disease, injury, or disability, or to the Food and Drug Administration (FDA) to report adverse events related to medications or products.
- Health Oversight Activities: We may disclose PHI to a health oversight agency for audits, investigations, inspections, or licensure actions.
- Lawsuits and Disputes: If you are involved in a lawsuit or a dispute, we may disclose your PHI in response to a court or administrative order, or a subpoena.
- To Avert a Serious Threat to Health or Safety: We may use and disclose your PHI when necessary to prevent a serious threat to your health and safety or the health and safety of the public.
4. Your Rights Regarding Your PHI
You have the following rights regarding the medical information we maintain about you:
- Right to Access and Inspect: You have the right to inspect and receive a copy of your PHI (including your medical intake records and prescription history). You can request this by emailing info@elementmd.com.
- Right to Amend: If you feel that the medical information we have about you is incorrect or incomplete, you may ask us to amend the information.
- Right to an Accounting of Disclosures: You have the right to request a list of certain disclosures we made of your PHI for purposes other than treatment, payment, and healthcare operations.
- Right to Request Restrictions: You have the right to request a restriction or limitation on the PHI we use or disclose about you. We are not legally required to agree to your request unless it involves a restriction on a disclosure to a health plan for purposes of carrying out payment, and you have paid for the service out-of-pocket in full.
- Right to Confidential Communications: You have the right to request that we communicate with you about medical matters in a certain way or at a certain location (for example, only by email or only at a specific address).
- Right to a Paper Copy of This Notice: You have the right to request a paper copy of this notice at any time.
